INFORMATION TEXT ON THE PERSONAL DATA PROTECTION LAW

At SMT Global Customs Consultancy Inc. ("SMT"), we respect the privacy of your personal data and prioritize data security, and this is a priority for our company. For the purpose of processing and protecting this personal data, we adhere to the principles of collecting, processing, and protecting the personal data of our customers, potential customers, website users, employees, prospective employees, former SMT employees, interns, company shareholders, company officials, business partners, group company employees, and visitors, in accordance with the regulations stipulated in Law No. 6698 on the Protection of Personal Data.

For this reason, we recommend that you carefully read this text, which explains how we process your personal data, with whom we share it, and how you can exercise your rights.

All personal data of all persons associated with SMT , including those who benefit from our services, may be recorded, stored, updated, and processed and shared with third parties, as permitted by legislation, for certain clear and legitimate purposes , provided that it complies with the law and the rule of honesty, in accordance with the Law on the Protection of Personal Data No. 6698, as long as your relationship with our company continues.

As SMT , as defined in the Personal Data Protection Law , we, as the “Data Controller”, determine the information we obtain from you within the scope of our relationship with you.

DEFINITIONS

(They are not the authority to evaluate questions and requests from Data Subjects, but merely the contact person.)

We attach importance to the safeguarding, collection, processing, transfer and destruction of personal data in our possession regarding our customers, potential customers, website users, employees, job candidates, former SMT employees, interns, company shareholders, company officials, business partners, group company employees, visitors and third parties within the framework of the Constitution of the Republic of Turkey, international agreements to which our country is a party, and relevant legislation, especially the Personal Data Protection Law No. 6698.

In this context, we may process your personal data that you share with us in accordance with the 6698 KVKK, in a limited, relevant and proportionate manner with our activities and purposes, and may transfer it to third parties at home and abroad, store it, use it for profiling and classify it.

Purpose of Processing Your Personal Data

In accordance with Articles 4, 5 and 6 of the 6698 KVKK, your personal data;

Method and Legal Reason for Collecting Your Personal Data

Your personal data may be collected verbally, in writing or electronically, in whole or in part, by automatic means, or by non-automatic means, provided that it is part of any data recording system, for the purpose and within the scope specified above.

Within the scope of the activities of carrying out commercial processes; contact forms, business cards, supplier information request forms, other commercial documents, payment information and documents, valuable documents, employee and intern candidate application forms, CVs, e-mail, website, various contracts, consumer complaint forms are collected verbally, in writing or electronically through various methods that can be obtained from outside our company, including our customers, suppliers and other third parties.

Transfer of Your Personal Data

Your personal data will be processed jointly with SMT, within the scope of the purposes listed above, in accordance with the KVKK and the legislation in force, by taking data security measures such as data protection, preventing unauthorized access and unlawful processing ;

It may be transferred to authorized public institutions and organizations in accordance with the obligations and needs arising from legal legislation, to intermediary financial institutions for the purpose of assessing financial risks, to independent audit firms for the purpose of carrying out audit processes, to our suppliers, shareholders and local/international organizations from which we receive support in our business processes, to domestic/international organizations from which we receive services within the scope of relevant contracts in order to carry out activities as affiliated partnerships and/or direct/indirect domestic/international SMT, and to other third parties.

Storage and Deletion of Data

Legislation requires that relevant personal data be stored for specific periods. Therefore, it is our company's responsibility to store personal data in accordance with the legislation and for the required period. These retention periods are defined in detail on a data-by-data basis in the prepared personal data inventory. Personal data is stored for the period stipulated by legislation or required by its purpose. Data is stored physically or electronically. Necessary security measures have been taken for the storage and preservation of data, and our company has provided a secure environment. Personal data that has expired is destroyed (deletion/destruction/anonymization) within six months.

Your Rights as a Data Subject

Within the framework of Article 11 of KVKK 6698,

To learn whether your personal data is being processed,

Request information regarding your personal data if it has been processed,

To learn the purpose of processing personal data and whether they are used in accordance with their purpose,

Knowing the third parties to whom your personal data is transferred, whether domestically or abroad,

Request correction of your personal data if it is processed incompletely or incorrectly,

Request the deletion or destruction of your personal data within the framework of the conditions stipulated in the KVKK legislation,

When you request the correction of incomplete or inaccurate data and the deletion or destruction of your personal data, you may request that this situation be notified to third parties to whom your personal data has been transferred,

To object to any adverse results arising from the analysis of processed data exclusively through automated systems,

To request compensation for damages in case you suffer damages due to unlawful processing of personal data,

By filling out a petition containing your request to exercise these rights or the Information Request Form at www.smtgumruk.com.tr ;

It will include the applicant's identity and address information (Documents proving your identity must be attached.),

The subject you request will be related to you personally,

If you are acting on behalf of someone else, you must be specifically authorized to do so and your authority must be documented.

You can convey your request clearly and understandably using one of the methods below.

Depending on the nature of your request within the scope of the above article, the request will be finalized as soon as possible (within 30 days at the latest) free of charge or in accordance with the conditions in the fee tariff determined by the Personal Data Protection Board.

As the relevant person, in accordance with Article 14 of the Law on the Protection of Personal Data No. 6698, in cases where the application is rejected, the response is found insufficient or the application is not responded to in a timely manner , you may file a complaint with the Board within thirty days from the date you learn of the response or, in any case, with the consent of the person, within sixty days from the date of application.

In accordance with Article 28/2 of the KVKK No. 6698, personal data owners cannot assert their other rights mentioned above, except for the right to demand compensation for damages, in the following cases:

Processing personal data is necessary for the prevention of crime or criminal investigation.

Processing of personal data made public by the personal data owner.

The processing of personal data is necessary for the execution of supervisory or regulatory duties or disciplinary investigation or prosecution by authorized public institutions and organizations and professional organizations with the status of public institutions, based on the authority granted by law.

The processing of personal data is necessary to protect the economic and financial interests of the State regarding budgetary, tax and financial matters.

OTHER MATTERS

In the processes covered by this Information Text on the Protection and Processing of Personal Data, the relevant legal regulations in force regarding the processing and protection of personal data will be applied with priority.
